Terms of Use

Effective October 14, 2026. These terms replace all earlier versions.

1. Agreement

These Terms of Use govern your use of firstoptioncapital.com (the "Site"), operated by First Option Capital, Inc. ("First Option Capital," "we," "us"). By using the Site you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Site. You must be at least 18 years old and use the Site for business purposes. The Site is intended for businesses in the United States.

2. Our services

First Option Capital provides and arranges equipment financing, leasing, vendor finance programs and related services for businesses. Depending on the transaction, financing may be provided by First Option Capital or by one of our funding partners. We are not a bank and do not accept deposits. Programs, terms and availability can change without notice and may not be available in every state.

3. No offer or commitment

Nothing on the Site is an offer to lend, a commitment to finance, a credit approval or a binding quote. All financing is subject to credit review and approval, documentation acceptable to us and our funding partners, and applicable law. Statements such as "approvals in minutes," "application-only up to $500,000," "100% financing," "deferred payments" and term ranges describe programs that may be available to qualified applicants; they are not guaranteed.

4. Calculators and illustrations

The payment estimator, financing snapshot, Section 179 calculator and transaction profiles are for illustration only. Payment ranges use assumed rates and do not include taxes, fees, insurance or other costs. Transaction profiles are hypothetical examples, not actual client results. Your actual rate, payment, term and costs depend on your credit, the equipment, the transaction size and other factors.

5. Required disclosures

Where federal or state law requires it, for example California's commercial financing disclosure law for qualifying transactions of $500,000 or less, you'll receive the required disclosures before you sign. These include the total amount financed, the total cost of financing, the payment amount and frequency, the term, the prepayment policy, and an estimated annual percentage rate (APR). Whenever we quote a rate where an APR disclosure is required, we'll also state the APR.

6. No tax, legal or accounting advice

Information on the Site, including anything about Section 179, depreciation or tax savings, is general information and not tax, legal, accounting or investment advice. Tax treatment depends on your situation and current law. Talk to your own advisors before making decisions.

7. Applications and the information you provide

You agree that information you give us is true, complete and current, and that you are authorized to provide it for the business you represent. Submitting a quote request, financing snapshot or contact form does not authorize a credit check. A credit check happens only with the written authorization in a formal credit application.

8. Electronic communications and signatures

You agree that we may give you notices, disclosures and documents electronically, and that electronic signatures and records have the same effect as paper ones under the federal E-SIGN Act and applicable state law. You can ask for paper copies or withdraw consent to electronic delivery by contacting us. Withdrawing consent may delay or prevent a transaction.

9. Calls and texts

If you check the consent box on one of our forms, you agree that we may call or text the number you provided about financing, including with automated technology. Consent is not required to get financing. Reply STOP to any text, or tell us, to opt out. Message and data rates may apply. Calls may be recorded for quality and compliance.

10. Third-party sites and services

The Site links to and embeds third-party services, including our financing request form at firstoptioncapital.net, HubSpot, review sites and social media. Their terms and privacy policies apply to your use of them. We're not responsible for third-party content or practices.

11. Acceptable use

You agree not to: misuse the Site or our forms; submit false or misleading information or information about someone else without authorization; attempt to gain unauthorized access, test vulnerabilities or disrupt the Site; use bots, scrapers or automated tools to collect content or data; or use the Site in violation of law.

12. Intellectual property

The Site's content, design, text, graphics and the First Option Capital name and logo belong to First Option Capital or its licensors and are protected by law. You may view and print pages for your own business use. Any other use requires our written permission. Photos and images are used under license or with permission and may not be copied.

13. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't guarantee that the Site will be uninterrupted, error-free or free of harmful components.

14. Limitation of liability

To the fullest extent the law allows, First Option Capital and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to $100. Some states don't allow these limits, so they may not apply to you. These terms do not limit rights under any financing agreement you sign, which is governed by its own terms.

15. Indemnity

You agree to indemnify and hold harmless First Option Capital from claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these terms or misuse of the Site.

16. Governing law and venue

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute about the Site will be resolved in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.

17. Accessibility

We want everyone to be able to use the Site. If you have trouble with any part of it, see our Accessibility Statement or call (800) 603-3945, and we'll help you directly.

18. Changes and general terms

We may update these terms by posting a new version with a new effective date. Continued use of the Site means you accept the updated terms. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. These terms and our Privacy Policy are the entire agreement between you and us about the Site.
