Privacy Policy
First Option Capital, Inc. ("First Option Capital," "we," "us") respects your privacy. This Privacy Policy explains what personal information we collect through firstoptioncapital.com (the "Site") and our related forms and communications, how we use and share it, and the choices and rights you have. It is written to meet the California Consumer Privacy Act as amended by the California Privacy Rights Act and its regulations ("CCPA"), the California Online Privacy Protection Act, and other U.S. state privacy laws that apply to us.
This policy is available in alternative formats on request. Call (800) 603-3945 or email info@firstoptioncapital.com.
1. Who we are and what this covers
We provide equipment financing, leasing, vendor finance programs and related services to businesses. This policy covers information about individuals that we collect online and offline in connection with the Site, including business contacts, owners and guarantors of businesses that seek financing, and visitors to the Site. It does not cover information handled under a separate privacy notice you receive when you sign a financing application or agreement.
2. Information we collect
In the past 12 months we have collected the following categories of personal information:
| Category | Examples |
|---|---|
| Identifiers | Name, business name, email address, phone number, postal address, IP address, online identifiers |
| Commercial and business information | Equipment you want to finance, amount and term, vendor, quote number, time in business, number of employees, industry, website |
| Professional information | Job title and role in the business |
| Internet or network activity | Pages viewed, links clicked, device and browser type, referring site, and use of our calculators. Analytics data is collected only if you allow analytics cookies. |
| Approximate location | City or region inferred from your IP address |
| Sensitive personal information | Only if you submit a formal credit application: for example Social Security number, date of birth, or bank account information of a business owner or guarantor. We use this only to evaluate and complete the financing you request and to meet legal obligations, not to infer characteristics about you. |
3. Where it comes from
- Directly from you, when you use our forms, call, email, or apply for financing
- Automatically from your device, through cookies and similar technologies, as described below

- To communicate with you about your request, application or account
- To operate, secure, troubleshoot and improve the Site
- To measure and improve our marketing, only with your permission where required
- To detect and prevent fraud, and to comply with legal, regulatory and audit obligations
5. Who we share it with
- Service providers and contractors that help us run our business under contracts limiting their use of your information, such as website hosting and form processing, customer relationship management (HubSpot), email and phone systems, and analytics providers if you allow analytics cookies
- Funding partners, lenders and lessors that evaluate and fund the financing you request
- Credit bureaus and verification services, only with the authorization in your credit application
- Equipment vendors involved in your transaction, to coordinate delivery and payment
- Advertising and social media partners, only if you allow marketing cookies (see "Selling and sharing")
- Government authorities, courts and professional advisors when required by law or to protect our rights

6. Selling and sharing
We do not sell personal information for money. If you allow marketing cookies, advertising partners such as Google, Meta, LinkedIn or HubSpot may receive identifiers and internet activity from the Site to measure ads and show you relevant advertising. California law may treat this as a "sale" or "sharing" for cross-context behavioral advertising. You can opt out at any time with Your privacy choices or Cookie settings at the bottom of every page, or by turning on Global Privacy Control in your browser. We do not knowingly sell or share the personal information of anyone under 16, and we do not use or disclose sensitive personal information for purposes that would give you a right to limit it under the CCPA.
7. Cookies, analytics and your choices
We use three kinds of cookies and similar technologies (including local storage and pixels):
| Type | What it does | Your choice |
|---|---|---|
| Essential | Keeps the Site secure, remembers your cookie and accessibility choices, and makes forms work | Always on |
| Analytics | Google Analytics measures visits and Site performance | Off until you allow it |
| Marketing | Google Ads, Meta Pixel, LinkedIn Insight Tag and HubSpot tracking measure advertising and help us follow up on your interest | Off until you allow it |
When you first visit, a banner lets you Accept all, Reject all or Customize. Rejecting is as easy as accepting, and the Site works either way. You can change or withdraw your choice anytime through Cookie settings. Google tools run in Google Consent Mode, so they don't store analytics or advertising cookies until you allow them. Our website fonts are hosted on our own servers and don't send your information to third parties.
Do Not Track. Browsers' "Do Not Track" settings have no common standard, so we don't respond to them. We do honor Global Privacy Control, described next.
8. Global Privacy Control
If your browser sends a Global Privacy Control (GPC) signal, we treat it as a valid request to opt out of the sale and sharing of your personal information and of targeted advertising, for that browser. Marketing cookies stay off, and the Site displays "Opt-Out Request Honored" so you can confirm we received it. If you're known to us, for example because you've given us your email address, we apply the opt-out to that information too.
9. How long we keep it
We keep personal information only as long as needed for the purposes above. Inquiries that don't lead to financing are generally kept up to 3 years. Records of financing applications and transactions are kept for the life of the transaction plus up to 7 years, or longer where required by law, regulation or a legal hold. Analytics data is kept for up to 14 months. We then delete or de-identify it.
10. Your privacy rights
California residents
Subject to legal exceptions, you have the right to:
- Know what personal information we collected, used, disclosed, sold or shared, including information collected before the last 12 months where available, and the categories of service providers and contractors that received it
- Access and receive a copy of your personal information
- Correct inaccurate personal information
- Delete personal information we collected from you
- Opt out of the sale or sharing of your personal information
- Not be discriminated against for exercising these rights
Shine the Light. California residents may ask once a year whether we disclosed personal information to third parties for their direct marketing. We do not do so.
Residents of other states
Depending on your state, including Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, you may have rights to confirm whether we process your personal data, and to access, correct, delete or obtain a portable copy of it. You may also have rights to opt out of targeted advertising, sale of personal data and profiling with significant effects, and to appeal our decision on your request. We extend these rights where the law applies to us and, where practical, to all U.S. residents.
11. How to make a request
- Call toll-free: (800) 603-3945
- Email: info@firstoptioncapital.com with "Privacy request" in the subject
- To opt out of sale or sharing: use Your privacy choices at the bottom of any page, or turn on Global Privacy Control
We'll confirm receipt within 10 business days and respond within 45 days, or tell you if we need up to 45 more days. To protect you, we'll verify your identity by matching information you provide with information we have; we don't need verification for opt-out requests. You may use an authorized agent with your signed permission, and we may ask you to confirm the request directly. If we deny your request, you can appeal by replying to our decision with "Appeal" in the subject line; we'll respond within the time the law requires. If you're not satisfied, you may contact your state attorney general.
12. Financing applications
Information you provide in a credit application, and information we obtain from credit reports with your authorization, is used to evaluate and service the financing you request. It is shared only with our funding partners and service providers as needed for that purpose and as permitted by law, including the federal Gramm-Leach-Bliley Act where it applies. Some of this information may be exempt from state privacy laws; we still protect it as described in this policy. Submitting a quote request, financing snapshot or contact form on the Site does not authorize a credit check.
13. Calls, texts and email
If you check the box on one of our forms, you agree that First Option Capital may call or text you at the number you provide about financing, including with automated technology. Consent is not a condition of getting financing. You can withdraw consent anytime by replying STOP to a text, telling us on a call, or emailing us, and we'll honor your request promptly. Message and data rates may apply. Every marketing email includes an unsubscribe link.
14. Automated decisions and AI
The Site does not make credit decisions. Calculators, estimates and the financing snapshot show illustrations only. Credit decisions are made by our team and our funding partners, who may use their own underwriting tools; ask us if you'd like more information about how a decision on your application was made. We do not use your personal information to train artificial intelligence or large language models.
15. Children
The Site is intended for businesses and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us information, contact us and we'll delete it.
16. Security
We use administrative, technical and physical safeguards appropriate to the information, including encrypted connections (HTTPS) for the Site and forms, limited access, and contracts requiring our service providers to protect your information. No method of transmission or storage is completely secure.
17. Other websites
The "Get financing" request form is provided on our companion site, firstoptioncapital.net, which connects to our HubSpot account and has its own cookie settings. Links to LinkedIn, Facebook, review sites and other third parties are governed by those parties' privacy policies.
18. Changes
We review this policy at least once a year. If we make material changes, we'll update the effective date and, where required, notify you or ask for your consent.
